1. Acceptance of Terms

By accessing or using SafeWatch ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SafeWatch provides AI-powered scam detection and protection services. Our service:

• Analyzes user-submitted text for potential fraud, phishing, and scam indicators
• Provides educational content about fraud prevention
• Uses machine learning algorithms to identify suspicious patterns
• Offers guidance to help users make safer decisions

3. User Eligibility

The Service is not intended for children under 13. By using SafeWatch, you represent and warrant that you are at least 13 years of age. If you are between the ages of 13 and the age of majority in your jurisdiction (usually 18), you represent that you have obtained the consent of your parent or legal guardian to use the Service and agree to these Terms.

4. User Responsibilities

When using SafeWatch, you agree to:

• Provide accurate information when required
• Use the Service only for its intended fraud protection purposes
• Not attempt to reverse engineer or compromise our security systems
• Not use the Service for illegal activities or to harm others
• Report any suspected vulnerabilities or issues to our support team

5. AI & Accuracy Disclaimer

• AI is Probabilistic: The Service provides a statistical prediction based on patterns, not a statement of fact.
• Possibility of Error: The Service may generate "false negatives" (failing to detect a scam) or "false positives" (flagging a safe message).
• No Financial Advice: SafeWatch is not a financial advisor, legal expert, or law enforcement agency. You should never rely solely on the Service to make financial decisions.
• Independent Verification: You should always verify suspicious messages through independent channels (e.g., calling your bank directly).

6. Privacy and Data Use

Your privacy is important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points include:

• User-Submitted Content: We analyze only the text you manually submit or paste into the app.
• No Raw Storage: We do not store your raw submissions with your personal identity after the analysis is complete.
• Data Security: Data is transmitted and processed using enterprise-grade encryption.

7. Intellectual Property

SafeWatch and its original content, features, and functionality are owned by SafeWatch and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Prohibited Uses

You may not use SafeWatch:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations or laws
• To transmit malicious code, viruses, or other harmful computer code
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To interfere with or circumvent the security features of the Service

9. Service Availability

We strive to keep SafeWatch available at all times, but we cannot guarantee uninterrupted service. We may:

• Perform scheduled maintenance that temporarily interrupts service
• Experience unexpected downtime due to technical issues
• Modify or discontinue features with reasonable notice
• Limit usage to ensure fair access for all users

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SAFEWATCH EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL SAFEWATCH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless SafeWatch and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

13. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

14. Governing Law

These Terms shall be interpreted and governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service will be resolved in the appropriate courts located within Massachusetts.

15. Apple Device and Payment Terms

If you have downloaded the App from the Apple App Store, the following terms apply:

• Acknowledgement: You acknowledge that these Terms are between you and SafeWatch only, not with Apple. SafeWatch, not Apple, is solely responsible for the App and the content thereof.
• Subscriptions: Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Management: You can manage and cancel subscriptions in your App Store account settings after purchase.
• Scope of License: The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control.
• Apple's Liability: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

17. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
